Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website swerv.work and all associated services (the “Service”) operated by Swerv (“Swerv,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

By using Swerv, you also agree to our Privacy Policy at swerv.work/privacy, which describes how we collect, use, and protect your personal information.


1. Description of Service

Swerv is a career pivot intelligence platform. The Service allows you to:

  • Upload a resume or CV to receive an AI-generated career analysis
  • Receive an AI Displacement Risk score for your current role
  • View matched career opportunities sourced from government contracts, federal employment, remote job boards, and other public data sources
  • Purchase a one-time Career Pivot Report for a fee
  • Subscribe to a recurring Weekly Digest of matched opportunities

The Service is designed to provide informational career guidance only. Swerv is not an employment agency, staffing firm, recruiter, or career counselor. We do not guarantee employment, interviews, or any specific career outcome.


2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.


3. Account and Access

The Service does not require you to create an account. Reports are accessed via unique, private URLs. You are responsible for keeping your report URLs confidential. Anyone with access to your report URL can view your report.

We are not responsible for unauthorized access to your report resulting from your sharing of the report URL.


4. Payments and Pricing

4.1 Career Pivot Report — One-Time Purchase

  • Price: $5.00 USD (one-time payment)
  • What you receive: A full career analysis including skill extraction, AI displacement risk score, up to 25 matched opportunities with match reasoning, AI-generated cover letters for top matches, and a 90-day action plan.
  • Access period: Your report is available for 30 days from the date of purchase. After 30 days, the report and all associated data are permanently deleted.
  • Delivery: Immediate digital delivery upon successful payment.

4.2 Weekly Swerv Digest — Subscription

  • Price: $9.99 USD per month (recurring)
  • What you receive: A weekly email containing newly matched opportunities based on your skill profile.
  • Billing cycle: Monthly, starting from the date of subscription.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial-month refunds are provided.
  • Auto-renewal: Your subscription automatically renews each month until cancelled.

4.3 Payment Processing

All payments are processed securely by Stripe, Inc. We do not collect, store, or have access to your payment card information. All payment processing is subject to Stripe's terms of service and privacy policy.

4.4 Currency

All prices are displayed and charged in United States Dollars (USD) unless otherwise stated. You are responsible for any currency conversion fees charged by your bank or payment provider.

4.5 Taxes

Prices do not include applicable taxes. Any sales tax, VAT, GST, HST, or other applicable taxes will be calculated and added at checkout based on your location, as required by law.


5. Refund Policy

5.1 Career Pivot Report

We offer a refund within 7 days of purchase if:

  • The Service failed to generate a report due to a technical error on our end
  • The report contains zero matched opportunities

Refunds are NOT available if:

  • You are unsatisfied with the quality, relevance, or number of matches (AI-generated results vary based on your profile and available data)
  • You have already downloaded the report as a PDF
  • More than 7 days have passed since purchase

5.2 Weekly Digest Subscription

  • No refunds for partial billing periods after cancellation
  • If the Service fails to deliver any digest emails during a billing period due to a technical error on our end, we will provide a pro-rated credit or refund for that period upon request

5.3 How to Request a Refund

Email support@swerv.work with the subject line “Refund Request” and include your report ID or subscription email address. We will respond within 5 business days.


6. User Conduct and Acceptable Use

You agree NOT to:

  • Upload any file that is not a genuine resume or CV
  • Upload files containing malware, viruses, or malicious code
  • Upload files exceeding 10 MB in size
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Use automated scripts, bots, or scrapers to access the Service, except through our documented public API endpoints (/api/v1/) within their published rate limits
  • Circumvent or attempt to circumvent rate limiting, authentication, or other security measures
  • Use the Service to collect personal information about other individuals
  • Resell, redistribute, or commercially exploit the content of reports without our prior written consent
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Use the Service for any illegal or unauthorized purpose
  • Interfere with or disrupt the Service or servers or networks connected to the Service

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to other users, us, or third parties.


7. Resume Upload and Data Processing

7.1 Your Responsibilities

By uploading a resume or CV, you represent and warrant that:

  • The resume is your own, or you have authorization from the individual whose resume you are uploading
  • The information contained in the resume is accurate to the best of your knowledge
  • The upload does not violate any third party's privacy, intellectual property, or other rights

7.2 Our Processing

When you upload a resume:

  1. We extract text from the PDF or DOCX file in server memory
  2. The extracted text is sent to Anthropic's Claude API for skill and career analysis
  3. We store only the structured output (skills, industries, experience level) and a non-reversible SHA-256 hash
  4. The uploaded file and raw text are immediately discarded from memory
  5. We do NOT store, copy, or retain your resume file or its raw text content at any point

8. AI-Generated Content Disclaimer

8.1 Nature of AI Output

The Service uses artificial intelligence (Anthropic's Claude) to analyze resumes, extract skills, score opportunities, calculate displacement risk, and generate cover letters and action plans. You acknowledge and agree that:

  • AI output is not professional advice. Our reports are informational tools, not substitutes for professional career counseling, legal advice, or financial advice. Important career decisions should be made in consultation with qualified professionals.
  • AI displacement risk scores are estimates. Risk scores are generated by AI models based on current trends and publicly available research. They are not predictions of your personal job security. Actual outcomes depend on many factors beyond what our model considers.
  • Match quality varies. Opportunity matching is based on AI interpretation of your skills and available listings. Matches may not always be relevant, and some relevant opportunities may not appear. We do not guarantee the accuracy, completeness, or relevance of any match.
  • Cover letters and action plans are drafts. AI-generated cover letters and action plans should be reviewed and customized before use. We are not responsible for the outcome of using AI-generated content in job applications.
  • Data freshness varies. Opportunity listings are sourced from third-party databases and may be delayed, expired, or inaccurate. Always verify listings directly with the employer or posting source before applying.

8.2 No Employment Guarantee

Swerv does not guarantee that using the Service will result in employment, interviews, career advancement, or any specific outcome. The Service provides information and analysis to support your decision-making. Career outcomes depend on factors entirely outside our control.


9. Third-Party Content and Links

9.1 Job Listings

The Service displays job opportunities sourced from third-party databases including USAJOBS, JSearch, Adzuna, government procurement portals, and other sources. We do not control these listings and are not responsible for:

  • The accuracy, completeness, or timeliness of any listing
  • Whether a listed position is still available
  • The terms, conditions, or legitimacy of any job posting
  • The hiring practices of any employer

9.2 External Links

The Service may contain links to third-party websites (e.g., job application pages, employer websites). We do not control or endorse these external sites and are not responsible for their content, privacy practices, or availability.


10. Intellectual Property

10.1 Our Intellectual Property

The Service, including its design, logos, text, graphics, code, and underlying technology, is owned by Swerv and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

10.2 Your Content

You retain ownership of the resume and information you upload. By uploading your resume, you grant us a limited, non-exclusive, non-transferable license to process your resume solely for the purpose of providing the Service. This license terminates when your report data is deleted (30 days after creation, or upon your request).

10.3 Report Content

The career analysis, match results, cover letters, and action plan generated by the Service are provided for your personal, non-commercial use. You may download, print, and use this content for your own career purposes. You may not resell, redistribute, or commercially exploit report content.


11. Public API

11.1 API Access

We provide free, public API endpoints at swerv.work/api/v1/ for querying career opportunity data and displacement risk scores. Use of these endpoints is subject to these Terms and the following additional conditions:

  • Rate limits: Free API access is limited to 10 requests per minute per IP address. Exceeding rate limits may result in temporary or permanent blocking.
  • Attribution: If you publicly display data obtained from our API, you must include attribution to “Swerv (swerv.work).”
  • No scraping: You may not use the API to systematically download or replicate our entire dataset.
  • Commercial use: Commercial use of API data beyond the free rate limits requires a separate agreement. Contact support@swerv.work.

11.2 API Availability

We provide the API on an “as is” basis and do not guarantee uptime, availability, or response times. We may modify, restrict, or discontinue API access at any time without notice.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

IN NO EVENT SHALL SWERV, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • COST OF PROCUREMENT OF SUBSTITUTE SERVICES
  • DAMAGES RESULTING FROM CAREER DECISIONS MADE BASED ON OUR REPORTS
  • DAMAGES RESULTING FROM INACCURATE, INCOMPLETE, OR OUTDATED JOB LISTINGS
  • DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR REPORT

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.


13. Indemnification

You agree to indemnify, defend, and hold harmless Swerv, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Content you upload to the Service

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.

14.2 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@swerv.work to attempt to resolve the dispute informally. We will make reasonable efforts to resolve your concern within 30 days.

14.3 Jurisdiction

If informal resolution is unsuccessful, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of British Columbia, Canada, and you consent to the personal jurisdiction of such courts.

14.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.


15. Service Modifications and Availability

We reserve the right to:

  • Modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice
  • Change pricing for future purchases or subscriptions with 30 days' notice to active subscribers
  • Update data sources, AI models, or matching algorithms
  • Impose limits on certain features or restrict access to parts of the Service

If we discontinue the Service entirely, active subscribers will receive a pro-rated refund for the unused portion of their current billing period.


16. Termination

16.1 By You

You may stop using the Service at any time. If you have an active subscription, you may cancel it through the cancellation link in your digest email or by contacting support@swerv.work.

16.2 By Us

We may terminate or suspend your access to the Service immediately, without prior notice, if:

  • You breach these Terms
  • We are required to do so by law
  • We reasonably believe your conduct poses a risk to other users, third parties, or the integrity of the Service

16.3 Effect of Termination

Upon termination:

  • Your right to access the Service ceases immediately
  • Sections 10, 12, 13, 14, and 17 survive termination
  • Any pending report data will be deleted in accordance with our standard 30-day retention schedule

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Swerv regarding the Service and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, government actions, power failures, internet or telecommunications failures, or third-party service provider outages.

17.6 Notices

We may provide notices to you via the Service, email (if you are a subscriber), or by posting on swerv.work. You may provide notices to us at support@swerv.work.
